Canadian Frontline Nurses et al. v. Canada, 2024 FC 42

Court Filing · Federal Court of Canada; Justice Richard G. Mosley · January 23, 2024

The Federal Court granted the Cornell/Gircys, CCLA and CCF applications in part, found the emergency proclamation unreasonable, and found unjustified paragraph 2(b) and section 8 Charter infringements. The Nagle/CFN application was dismissed for lack of standing.

I find that the failure to require that some objective standard be satisfied before the accounts were frozen breached s. 8.

Paragraph 341

The Federal Court granted the Cornell/Gircys, CCLA and CCF applications in part, found the emergency proclamation unreasonable, and found unjustified paragraph 2(b) and section 8 Charter infringements. The Nagle/CFN application was dismissed for lack of standing. Paragraph 177 states that Cornell and Gircys had accounts frozen. Later appellate status appears in SCC-23 and SCC-24.
